- In recalling the falsified incident of this "confession," Martin claimed that Kirstin had "boasted." That was inconsistent with the fact that while in jail, Kirstin had been tearing the articles about her trial out of the newspaper to save herself from humiliation.

- The Clark County Public Defender's Office provided her with inadequate legal counsel. They missed key deadlines during the progression of her trial. This office is understaffed and underfunded, as it states in this recent article by the Las Vegas Sun.

- The prosecutor used the sexual abuse Kirstin had suffered in her childhood as a prop in the courtroom in order to try to suggest what he called "proof of her hatred for men." This unrelated trauma was exploited viciously in his attempts to win over the jury.

- The police and the PA twisted her story into what would fit the murder, not the other way around. Any discrepancies they found were chalked up to the "drug induced haze" she wasn't actually in. During their questioning they never once mentioned a date - The only date reference was "a couple of weeks ago."

- While under oath, the police detective denied ever speaking with her parents on the telephone, because he would have had to admit that they told him she was at home when the murder occurred.

- In Kirstin's description of her attacker she said that he was a large man, over 6 ft tall.  She stated he was much taller than she was (she was wearing high heeled shoes), and that he was a heavy man, over 200 lbs.

Duran Bailey was 5' 10" tall and weighed 133 lbs.
