- Kirstin Lobato was not in Las Vegas when Duran Bailey was murdered. - She was not in a "drug induced haze" (as the prosecutor claimed) during the time of his murder. Laboratory blood tests from July prove this. - No physical evidence was found at the scene of the crime that was in any way linked to Kirstin. There was physical evidence found at the crime scene, which an expert witness told the newspapers was "exclusionary on her behalf." - Her "confession" was not about the murder of Duran Bailey. It was about what happened during an attempted rape perpetrated by a different man 6 weeks prior to his murder. - The police did not pursue leads stemming from the woman Duran Bailey raped the week before he was found murdered. - Blood spatter evidence shows that it would have been physically impossible for Kirstin, at 5'7", 125 lbs, to have been capable of providing the kind of brute force that was evident at the scene of the crime. - A jailhouse snitch who had committed perjury prior was the State's key witness. Korinda Martin claimed on the stand that Kirstin had confessed to her in jail. This conversation never happened. Martin received a plea bargain out of the majority of her remaining jail time in return for this "testimony."
